Terms & Conditions

These terms are governed by the laws of Malaysia and the jurisdiction of the courts of Johor Bahru.

1. Definitions

  • "We / Us / Our / Sahabat Advocates" refers to Sahabat Advocates, a legal practice based at Unit 14A, Menara KOMTAR JBCC, 80000 Johor Bahru, Johor.
  • "Service" refers to the legal services described on this website, including consultations, HR policy review, and Industrial Court representation.
  • "User / You" refers to any person accessing this website or engaging our services.
  • "Website" refers to the site located at sahabata.pro.
  • "Agreement" refers to the engagement letter or written confirmation of instructions exchanged between you and us when a matter is formally retained.

2. Acceptance of Terms

By accessing this website or submitting an enquiry through our contact form, you confirm that you have read and agree to these Terms & Conditions. Our services are intended for individuals aged 18 and above. If you are accessing this site on behalf of an organisation, you confirm that you have the authority to bind that organisation to these terms.

3. Website Use

The content on this website is provided for general information purposes only. It does not constitute legal advice and should not be relied upon as such without obtaining specific advice tailored to your circumstances. Browsing this website does not create a solicitor-client relationship between you and Sahabat Advocates.

4. Engagement of Services

A client relationship is established only upon confirmation in writing — typically via an engagement letter or retainer agreement. Submitting an enquiry form does not constitute engagement. We reserve the right to decline any matter without giving reasons, including where a conflict of interest exists or where we consider the matter outside the scope of our practice.

5. Service Descriptions

The three services offered by Sahabat Advocates are:

  • Employee Rights Consultation & Strategy Session (RM 550): A one-hour confidential session with document review and written summary.
  • Employer HR Policy Review & Handbook Drafting (RM 2,200): A full policy and handbook engagement as described on our Solutions page, including one round of revisions.
  • Industrial Court Representation & Dispute Resolution (RM 3,850): Full-scope representation from Form N through to post-award advice, as outlined in the Solutions page. Final scope is confirmed in the engagement letter.

Service descriptions on the website are provided for guidance. The scope of any engagement is defined by the written agreement between the parties.

6. Payment Terms

Fees are quoted in Malaysian Ringgit (RM). Payment terms are specified in the engagement letter for each matter. For fixed-fee services (consultation and handbook review), payment is required prior to commencement. For Industrial Court representation, a retainer is required upon engagement with further billing milestones as agreed. We accept bank transfer. Receipts are issued for all payments received.

7. Cancellation and Refund

For consultation appointments cancelled with more than 48 hours' notice, the full fee will be refunded or applied to a rescheduled appointment. Cancellations within 48 hours of the appointment are non-refundable. For ongoing engagements, fees for work already completed are not refundable. Any partial refund on termination of an ongoing matter will be assessed based on the work performed to date.

8. Professional Conduct

Sahabat Advocates operates in accordance with the Legal Profession Act 1976 (Malaysia), the Legal Profession (Practice and Etiquette) Rules 1978, and the professional conduct rules of the Malaysian Bar. We maintain professional indemnity insurance. Legal professional privilege applies to communications between a client and their legal adviser in the context of legal advice or proceedings.

9. Intellectual Property

The content of this website, including text, layout, and structure, is the intellectual property of Sahabat Advocates. Draft documents produced for clients as part of an engagement may be used by the client for the purpose for which they were produced but may not be reproduced for commercial distribution or attributed to Sahabat Advocates without consent.

10. Disclaimers

Legal outcomes cannot be predicted with certainty. Information on this website reflects the law as understood at the time of writing and may not reflect subsequent legislative or judicial developments. Our advice is based on the facts as presented to us; if those facts change or were incomplete, the advice may no longer apply. We do not warrant specific results from the use of our services.

11. Limitation of Liability

To the extent permitted by Malaysian law, our liability to you arising from or in connection with our services shall not exceed the total fees paid to us in the matter giving rise to the claim. We are not liable for indirect, consequential, or economic loss arising from the use of this website or our services, except where such loss results from our fraud or wilful misconduct.

12. Termination

Either party may terminate an engagement by giving written notice. We may terminate immediately if a conflict of interest arises, if instructions require us to act unethically, or if fees are not paid in accordance with the agreed terms. On termination, you remain responsible for fees for work completed. We will take reasonable steps to protect your interests on withdrawal, including advising you of relevant deadlines.

13. Dispute Resolution

In the event of a dispute arising from our services, we encourage you to first contact us at [email protected] to attempt informal resolution. If unresolved, complaints about professional conduct may be referred to the Malaysian Bar. Disputes of a contractual nature are subject to the jurisdiction of the courts of Malaysia, with Johor Bahru as the first choice of forum.

14. Changes to These Terms

We may revise these Terms & Conditions from time to time. Changes will be reflected on this page with an updated date. Your continued use of the website or services following any update constitutes acceptance of the revised terms.
